COVID-19 in Prison; Yasonna to Release 30,000 Inmates Early

TEMPO.CO, Jakarta - Minister of Law and Human Rights Yasonna Laoly has decided on the early release of 30,000 inmates and children through assimilation and integration, in order to minimize the spread of coronavirus or COVID-19 in correctional facilities.

"There are about just over thirty thousand inmates," Yasonna said through a short message, on Tuesday, March 31.

The decision to release the inmates early has been penned through the Minister of Law and Human Rights Decree numbered M.HH-19.PK/01.04.04 dated March 30, 2020. 

There are five requirements for the release of prisoners through assimilation.

First, inmates who have two-thirds of their sentences extend to December 31, 2020. Second, children who have half of their sentences extend to December 31, 2020. 

Third, prisoners and children who are not related to Government Regulation No. 99/2012, who are not undergoing subsidies and are not foreign citizens.

Fourth, the assimilation process will be done at home. Fifth, the release through assimilation decree will be issued by the Chief of Correctional Facilities, the Chief of the LPKA (Juvenile Rehabilitation Institute), and the Chief of Detention Center.

Similarly, the release of inmates and children through integration (parole, conditional leave, preterm leave) will also be carried out through the fulfillment of five requirements.

First, prisoners who have served two-thirds of their sentences. Second, children who have served half of their sentences. Thirdly, inmates and children who are not related to Government Regulation No. 12/1999, who are not undergoing subsidies and are not foreign citizens.

Fourth, suggestions for release through integration will be done through a correctional database system. Fifth, the release through integration decree will be issued by the Director General of Corrections.
