TEMPO.CO, Jakarta - The Attorney General’s Office (AGO) postponed the execution of Baiq Nuril Maknun, an honorary teacher of SMA 7 (public high school) Mataram, West Nusa Tenggara.
“By seeing the aspiration that develops in the community towards the perception of justice, we will postpone the execution,” said the Attorney General’s Office of Legal Information Center, Mukri, Monday, November 19.
Mukri said the postponement was due to a letter requesting a suspension of execution from the lawyer team of Baiq Nuril. “As soon as possible, so that this case does not drag on and there is a final legal effort. The judicial review is the right of the defendant,” Mukri said.
Despite postponing the execution, Mukri said Baiq's guilty status had not been separated. “On that basis, the defendant was tried in the Mataram District Court and at the district court level, the defendant was decided to be purely free,” Mukri said.
However, Mukri said that according to operational standards, the prosecutor had the right to file an appeal if the judge sentenced Baiq to be free or not according to the prosecutor’s wishes.
The execution by prosecutor was the aftermath of the Supreme Court’s cassation verdict which sentenced Baiq Nuril to 6 months in prison and a fine of Rp500 million subsidiary 3 months in prison for violating Article 27 (1) in conjunction with Article 45 (1) of the ITE Law.
Baiq Nuril was reported by the Principal of SMAN 7 Mataram, West Nusa Tenggara, whose initial was M, to the police on charges of transmitting electronic records containing immoral content. The recording was allegedly containing the principal’s confession, which led to the sexual harassment to Nuril.
